In the event a holiday falls on a Saturday or Sunday, the Building Holiday shall be the nationally recognized day either preceding or following such holiday.
Tenant shall e-mail or hand-deliver a notice to Landlord prior to each occasion when Tenant desires to receive after hours HVAC services: (i) after 8:00 p.m. and before 7:00 a.m. on a Business Day; (ii) at any time after 1:00 p.m. and before 8:00 a.m. on a Saturday that is not a Building Holiday; or (iii) on a Sunday or Building Holiday.
Notwithstanding anything contained herein, (a) in no event shall the After-Hours HVAC Charge ever be less than $50.00 per hour (b) Tenant shall not be obligated to pay the After-Hours HVAC Charge for overtime HVAC during the time period of 8:00 a.m. to 1:00 p.m. on Saturdays unless such Saturday is a Building Holiday.
Upon request by Tenant in accordance with the procedures established by Landlord from time to time for furnishing HVAC and lighting service at times other than the then current Business Hours, Landlord shall furnish such after hours service to Tenant (provided that with respect to lighting and plug electricity only, “after hours” shall mean any use in excess of a total of sixty-five (65) hours in any week (prorated in the event of any Building Holiday).
If the Termination Date or prior expiration of the Term falls on a Sunday or a Building Holiday, this Lease shall expire at 11:59 p.m. on the last business day preceding said date.
Any notices given in accordance with this Article 28 shall be deemed to have been given (i) on the date of personal delivery or (ii) on the earlier of the date of delivery or attempted delivery (as shown by the courier service delivery record or return receipt) if sent by courier service or mailed; provided, however, if such notice would otherwise be deemed given on a weekend or on a Building Holiday, such notice shall be deemed given on the next-succeeding business day.
