  • A business shall be deemed a Competitive Business if it shall operate a chain of home improvement stores (such as Home Depot, Lowe's, Eagle Hardware, Orchard Supply & Hardware, or Builders Square) that includes a store located within 10 miles of any "then existing" HomeBase warehouse store.

  • For purposes hereof, the “Master Lease” is that certain Lease dated April 20, 1993, as amended by letter agreements dated April 20, 1993, March 7, 1996 and January 15, 1997, and by Amendment to Lease dated 4/15/03, between Lincoln Plaza Associates (“Master Landlord”) and Builders Square, Inc.

  • Neither Home nor Builders Square shall make any representations to any customer or any other person or entity that implies that Builders Square is an ostensible or apparent agent, partner or joint venturer of Home or that Home is an ostensible or apparent agent, partner or joint venturer of Builders Square.

  • Home shall retain ownership of the hardware and software and shall allow Builders Square to use the same free of charge for the term of this Agreement.

  • Anything falling under the description of Equipment or Inventory in Paragraphs 2 and 4 above ordered in the ordinary course of business by or on behalf of Builders Square or BSQ Newco but not yet received prior to the Effective Date ("GOODS IN TRANSIT"); provided that the interest of Borrower in such Equipment may be in the form of a leasehold interest.
