Bottled Product definition

Bottled Product means Product that is packed in bottles in a packaging configuration approved by the FDA under a Regulatory Application that is ready for commercial distribution in the Field in the Territory or, alternatively, Product that is packed in bulk form in drums.

Bottled Product means those products set forth on Exhibit A which shall be processed and bottled by Packer in accordance with the Specifications. If the parties agree to add any new or additional Bottled Product, Exhibit A shall be amended in writing accordingly.

Examples of Bottled Product in a sentence

  • If SAC fails to maintain, for any continuous period of six (6) months ("Comparison Period"), an average price for 3 Liter Bottled Product at or below the "Average Product Price" or a quality of 3 Liter Bottled Product at a level equal to or better than the "Customary Product Quality," Member shall have the option to terminate its purchase obligation under this Agreement upon sixty (60) days' written notice delivered to SAC within three (3) months after the close of the Comparison Period.

  • For this purpose, a Member's proportionate interest shall be measured by its 3 Liter Bottled Product patronage volume over the preceding twelve (12) month period in comparison with the total 3 Liter Bottled Product patronage volume for SAC during such period.

  • Member agrees to provide SAC with estimates of its purchases of 3 Liter Bottled Product at such times and places as shall be required by the SAC Board.

  • SAC will sell 3 Liter Bottled Product at such prices as may be set from time to time by the SAC Board and shall make patronage refunds in accordance with SAC's Bylaws ("Bylaws").

  • SAC shall ship 3 Liter Bottled Product to Member within a reasonable time after receipt of an order from Member that is within ten percent (10%) of the estimated amount previously submitted to SAC by Member for such period.

  • Only in the event Packer is unable to manufacture for the Company a volume of Bottled Product in excess of the Annual Commitment, after Company having first given the Packer the opportunity to produce the then excess amount of Bottled Product, is Company allowed to have the Bottled Product manufactured by an alternative packer and only for a duration not to exceed twelve (12) months.

  • The Investor shall be required to pay any and all amounts owed by Company to Packer under this Agreement in connection with the purchase of Bottled Product and the shortfall amount as described in Section 10.3(b) and 10.4 up to a maximum amount as set forth in the following chart contained within this Section 10.5 for the Contract Year in which the Company has not fulfilled its payment/financial obligations to Packer.

  • Notwithstanding the foregoing provisions of this Section 3.3(a), Product subject to Depomed purchase orders [***] lots of Gralise ™ 300mg and [***] lots of Gralise ™ 600mg will be delivered not later than [***] for bulk product and [***] for Bottled Product and [***] lot of Gralise ™ 300mg and [***] lots of Gralise ™ 600mg will be Delivered not later than [***].

  • Upon termination of this Agreement, and provided that Company has paid in full all amounts which it owes to Packer hereunder, if any, Packer shall release for pick-up by Company all Bottled Product or other Company Materials in Packer’s possession which are the property of Company.

  • For this purpose, a Member's proportionate interest shall be measured by its 20 Oz Bottled Product patronage volume over the preceding twelve (12) month period in comparison with the total 20 Oz Bottled Product patronage volume for SAC during such period.
