I also agree that BLUE STREAM may suspend or cancel my account for exceeding any BLUE STREAM listed monthly limits for data transfer, using all or part of the HSI Service to post content to the Internet or to engage in “peer to peer” file exchanges or other forms of file exchanges that violate this Agreement or the Terms of Use.
In the event BLUE STREAM fails to repair and/or replace any damage to the property resulting from the operation, maintenance or repair of the System after a thirty (30) day written notice from the Association, the Association may undertake the necessary repairs and/or replacement of such damage to the property, and BLUE STREAM will be responsible to reimburse the Association for any such costs within thirty (30) days of receipt of a written invoice from the Association.
I agree to defend, indemnify and hold harmless the BLUE STREAM Parties from and against any and all claims and expenses, including reasonable attorneys’ fees, arising out of or related in any way to my use of the Services or otherwise arising out of the use of my account or any equipment or facilities in connection therewith, or my use of any other BLUE STREAM products or Services.
