This Agreement to the Allottee by BIPL does not create a binding obligation on the part of the BIPL or the Allottee until, firstly, the Allottee signs and delivers this Agreement with all the schedules along with the payments due as stipulated in the Payment Plan within 30 (thirty) days from the date of receipt of allotment agreement by the Allottee.
That in case there are Joint Allottees all communications shall be sent by the BIPL to the Allottee whose name appears first and at the address given by him/her, which shall for all intents and purposes to consider as properly served on all the Allottees.
In such a situation the BIPL shall have the entire lien & charge on the said Residential Plot & shall have a right to cancel this Allotment Cum Acceptance letter unilaterally, with prior intimation to you and BIPL will also have right to sell the said Residential Plot, allotted to you, in favour of any other person/party, as it may deem fit, and you shall not be entitled to question such sale or to claim any amount, whatsoever from the BIPL.
That all notices to be served on the Allottee and BIPL as contemplated by this Agreement shall be deemed to have been duly served if sent to the Allottee or the Promoter by Registered Post at their respective addresses specified in the booking form.
You also agree that you have clearly understood that, if the delay is caused due to non-payment of the instalment amounts as per the schedule mentioned in Clause 2(C) or due to any other act or omission on your part, then the time for completion & handing over of the possession of the said residential Plot shall automatically stand extended, till it is completed and at the convenience & discretion of the BIPL, the possession shall be handed over to you, only after all the dues are made clear by you.
You agree that any agreement if executed between you and the BIPL, shall be executed in duplicate and both the parties shall keep one original copy each for their record.
BIAC and BIPL have developed a project and an operational MOU regarding use of this space, which will be shared equally between the two organizations.
BIM understands that BIAC and BIPL are fully responsible for all costs of construction of a building and outdoor plaza.
BIPL take the responsible to provide and maintain essential services in the Project until obtaining occupancy certificate from the competent authority and cost of such maintenance has been included in the total price mentioned in Clause 2 (A).
At the time of possession/ execution of the conveyance deed the BIPL shall handover lawful, vacant, peaceful, physical possession of the plot to you and the common areas to the Residential Welfare Society / Association of Allottees or the competent authority, as the case may be.
