  • Each letter will be sent on behalf of BGEC, and name each BGEC Member.

  • Following the issuance of a certificate of occupancy for the Project, the surviving BGEC obligations under this Section shall be limited to public statements of opposition, including, but not limited to, comments to the media and in public hearings, and only those comments made by, or at the direction of, Covered Parties.

  • Obligations of a BGEC Member shall be obligations only of the organization itself as distinct from its associated organizations, constituent organizations or any natural persons.

  • Neither BGEC nor any BGEC Member has any obligation under this Agreement to express support for, or refrain from expressing opposition to, any future development activities on or near the Project Site other than the Project.

  • In an action by BGEC or a BGEC Member against North10 for any alleged breach, the court may order any equitable or injunctive relief, or issue an order of specific performance, which may include, without limitation, termination of this Agreement.

  • BGEC may waive this attendance requirement in writing, which waiver will not be unreasonably withheld, delayed or conditioned.
