BFSM agrees that the Health and Safety Plan is submitted to the Department only for informational purposes.
BFSM shall implement a groundwater-monitoring program if required by the Department.
BFSM shall document the characterization results and ultimate disposition of the materials to the Department within sixty (60) days of removal of any material from the Property.
BFSM shall preserve items on the Property that may: 1) provide evidence of a Potentially Responsible Party's involvement at the Site; 2) lead to the discovery of other areas of Contamination at the Site; or 3) contain environmental information related to the Site.
