  • Delivery by Bevco Engineering Company (“Seller”) to Customer of the materials shall constitute acceptance of both the materials and the terms and conditions herein unless expressly disclaimed in writing by both parties.

  • Bevco and SAB each has the necessary corporate power and authority to execute, deliver and perform this Agreement and the Related Agreements.
