We make no promises that any Beta Versions will ever be made generally available.
Beta Versions are intended for evaluation purposes and not for production use, are not supported, and may be subject to additional terms.
We may offer certain Products to you at no charge, including free accounts, trial use, and access to Beta Versions as defined below (“No-Charge Products”).
We may discontinue Beta Versions at any time in our sole discretion and may never make them generally available.
In some circumstances, we may charge a fee in order to allow you to access Beta Versions, but the Beta Versions will still remain subject to this Section 11 (No-Charge Products).
Clients should note that the Company is not liable for any financial losses or disruptions to services the Client may face as a result of using Beta Versions.
Ventiv will not be liable for any damages whatsoever that arise out of Customer’s use of the Beta Version if Customer attempts to use the Beta Versions with anything other than test data in a test environment.
The Developer shall prior to delivery correct Errors discovered as a result of that testing, and also (in accordance with the procedure set out in this paragraph) any Errors notified to the Developer by the Publisher following the Publisher’s testing of any Alpha or Beta Versions, or other Product materials supplied before delivery of the Alpha Version, Beta Version and the Gold Master.
All Beta Versions will be identified as such and the Client accepts all risks.
Customer acknowledges and agrees that Ventiv may use, without restriction, all suggestions, improvements and ideas concerning any part of the System (including without limitation any Beta Versions as defined in Section 16 below) or Intellectual Property Rights therein that may be communicated to Ventiv by Customer.
