Best in Class term means the actual performance in an organisation’s own defined market place. Measured key performance indicators may be set against average industry performances, but to be competitive more than average is required. Being in the top 10% of organisations is a requirement for the best in class (Fewings, 2005: 94).
Best in Class shall have the meaning set forth in Section 3.4.
Best in Class means that the price of a Service (with respect to (i) above) and/or the Service Levels for such Service (with respect to (ii) above) are within the top quartile (i.e., the most favorable to customers) identified by the Benchmarker in the Benchmarking Results (excluding “outliers”). If a Benchmarking Condition exists, the Parties shall promptly meet and enter into good faith negotiations to determine what adjustments to the Services, the pricing and/or the Service Levels are required to confirm that the Services provided under this Agreement are “Best in Class.”
Best in Class price management means selling the product at the “best” price while achieving volume targets within one’s market share bands. In case of deviations, dynamic adjustments are required.
Best in Class means that an Internet-based local search publishing platform’s architecture, functions, features, search, search engine optimization, design, performance and operation (when taken as a whole) share attributes at least as good as those found in comparable European Internet Yellow Page publishing solutions that at least offer local search, and that the publishing platform’s off-the-shelf versions of the application software licensable to the Customer under this Agreement would reasonably be considered one of the top three Yellow Pages destination sites in Europe, excluding other Local Matters clients using similar services of Local Matters.
