Berths definition

Berths has the meaning set forth in the Recitals.
Berths means all areas alongside the Wharves used to berth vessels.
Berths means every mooring berth situated within the RESIDENTIAL DEVELOPMENT COMPONENT and such mooring berths situated within the COMMERCIAL DEVELOPMENT COMPONENT, which mooring berths are adjacent to the RESIDENTIAL DEVELOPMENT COMPONENT;

  • Operator will not be obligated to receive Contaminated Product for throughput across the Berths, nor will Operator be obligated to accept Product that fails to meet the quality specifications set forth in the arrival notice.

  • Operator may, without prejudice to any other remedy available to Operator, reject and return Contaminated Product to Customer, even after delivery to Operator at the Berths.

  • Customer warrants to Operator that all Product tendered by or for the account of Customer for throughput across the Berths will conform to Operator’s minimum specifications for such Product and the most recently available and commonly accepted assay and any applicable API or ASTM standards.

  • For purposes of this Agreement, Customer’s Marine Vessels and personnel shall include those of Customer and/or its suppliers and trade partners accessing the Berths.


More Definitions of Berths

Berths means a location at a harbour where a vessel may be moored.
Berths have the meanings given to such terms in the BAUTA.
