BEE Requirements definition
BEE Requirements means, to the extent applicable to the business of the Group, the requirements for BEE compliance set out in:
2.1.11.1 the MPRDA;
2.1.11.2 the Mining Charter;
2.1.11.3 the Code; and/or
2.1.11.4 any other legislation or regulation which supersedes, overrides or complements the above;
BEE Requirements the requirements of all laws including the MPRDA, which relate to any black economic empowerment requirements or aspects of the Mining Right, Prospecting Right (or any mining rights that are granted in respect thereof) or Prospecting Right Applications (or any prospecting or mining rights that are granted in respect thereof) or which relate to the black economic empowerment requirements directly or indirectly applicable to the Purchaser, as well as and including, in particular, the HDSA ownership requirements stipulated in the Amendment of the Broad-Based Socio-Economic Empowerment Charter for the South African Mining Industry, September 2010 and the Codes of Good Practice for the Minerals Industry published on 29 April 2009;
BEE Requirements means the BEE requirements applicable to the Trust and/or the Company (as the case may be) from time to time which are of general or substantially general application, whether or not they have the force of law, including the requirements set out in the BBBEE Act, the Codes and the Mining Charter;
