The Private Party shall: undertake and complete the Works, as specified in Schedule 1; meet the Environmental Specifications set out in Schedule 2; meet the BEE Obligations set out in Schedule 3; provide the Project Assets; provide the Operation and Maintenance, in accordance with and in terms of this Agreement.
The Private Party shall deliver or procure the delivery of the Operation and Maintenance in accordance with the Works Specifications, the Environmental Specifications, BEE Obligations and the Operation and Maintenance Specifications on the Operation Commencement Date.
