BCOA definition

BCOA means the Bituminous Coal Operators’ Association, Inc.
BCOA means the Bituminous Coal Operators’ Association, Inc. For purposes of any action required or permitted under this Plan, any action of the Employers which may, or must, be taken hereunder may be taken only by BCOA. Any action which must be taken in writing shall be signed by the President of BCOA. In the event that BCOA ceases to exist then such action may be taken by a majority vote, based on tonnage, of those employers who are operating, at the time of such action, the signatory mines of BCOA members that were covered by the 2016 National Bituminous Coal Wage Agreement.
BCOA means the Bituminous Coal Operators’ Association, Inc. For purposes of any action required or permitted under this Plan, if the BCOA ceases to exist, or if more than 50 percent of the tonnage membership of the BCOA on the Effective Date of the 2016 Wage Agreement has withdrawn from BCOA, then the Employers representing a majority vote, weighted by tonnage produced as of the time of such action, of existing Employers who were BCOA members on the Effective Date of the 2016 Wage Agreement shall have all the rights and obligations of the BCOA.

  • Notwithstanding anything to the contrary in this Agreement, (a) the Closing Payment otherwise payable to Earlybird Verwaltungs GmbH pursuant to Section 1.10(b)(i) shall be reduced by Forty Thousand United States Dollars (US $40,000) and (b) the Closing Payment paid to each of BCOA Nominees Limited and Chemolio Holding AG pursuant to Section 1.10(b)(i) shall be increased by Twenty Thousand United States Dollars (US $20,000).

  • In order to fully fund these guaranteed benefits, the BCOA may increase, not decrease, the rate of contributions to be made to the 1974 Pension Trust during the term of the 2011 NBCWA.
