Any holder that fails to respond to the Offer Notice shall be deemed to have rejected the offer to prepay such holder’s Base Offer Amount and not to have exercised the Excess Amount Election and any holder of Notes which are repaid or prepaid in full on or after the date of any Disposition but prior to the Disposition Prepayment Date shall be deemed to have rejected the offer to prepay such Notes (and any amounts allocable to such Notes shall constitute part of the Excess Amount).
The Alternative offers will not be considered if Base Offer is not submitted.
The Contractor’s Base Offer per Bus as submitted on Appendix B, Cost Proposal, shall remain firm during the first 180 days of the Contract.

The price(s) of any buses or equipment ordered by the CCCTA or other procuring agencies after the initial 180 day firm fixed price period shall be that quoted (Base Offer per Bus) plus/minus any adjustment which will be calculated based on the U.S. Department of Labor/Bureau of Labor Statistics Producer Price Index (PPI) Category 1413, “Trucks and Bus Bodies” formula as described in the Section 11.Q 13.T of the RFP.
If requested, the Base Offer per Bus shall be that quoted plus/minus any adjustment which will be calculated based on the U.S. Department of Labor/Bureau of Labor Statistics Producer Price Index (PPI) Category 1413, “Trucks and Bus Bodies” formula as described in the Section 13.T of the RFP.
