Bare Transfer definition

Bare Transfer has the meaning given in clause 12.2(a).
Bare Transfer means an assignment under which the assignor assigns the whole or a part of its access rights under an access contract to an assignee, but under which there is no novation, with the result that the assignor’s obligations under the access contract for services, and all other terms of the access contract for services, remain in full force and effect after the assignment, whether or not the assignee becomes bound to the assignor or any other party to fulfil those obligations.
Bare Transfer means a transfer or assignment by the Shipper of its entitlement to capacity under the Access Contract in circumstances where:

Examples of Bare Transfer in a sentence

  • In these circumstances the Trading Policy may require that the transferee notify the Service Provider prior to utilising the portion of the Contracted Capacity subject to the Bare Transfer and of the nature of the Contracted Capacity subject to the Bare Transfer, but the Trading Policy must not require any other details regarding the transaction to be provided to the Service Provider.

More Definitions of Bare Transfer

Bare Transfer means a transfer or assignment of any interest in the right to obtain a Service (including, but without limitation, a sub-licence) in which the contract between CRP and the User remains in effect in terms identical to those existing between CRP and the User immediately prior to that transfer or assignment.
