All construction, if any, heretofore performed with respect to the Improvements has been performed within the perimeter of the Land in accordance with the Plans and Specifications as approved by Bank's Architect and in accordance with any restrictive covenants applicable thereto.
It will, upon demand of Bank's Architect, correct any structural defect in the Improvements or any material departure from the Plans and Specifications not approved by Bank's Architect, and the advance of and proceeds of the Loan shall not constitute a waiver of Bank's right to require compliance with this covenant with respect to any such defects or departures from the Plans and Specifications not theretofore discovered by, or called to the attention of, Bank's Architect.
The percentage of completion of construction at any time and the estimated total cost of construction shall be determined by Bank's Architect in his sole but reasonable discretion.
