Notwithstanding the provisions of this Section 3.7, Intrexon shall not, outside of the Bacteriophage Program, utilize any Ampliphi trial data or reports in support of obtaining regulatory approval for a product for use in the Field.

Each Party will provide the other Party with the opportunity to review and comment, prior to submission or presentation, on external reports, publications and presentations (e.g., press releases, reports to government agencies, abstracts, posters, manuscripts and oral presentations) that refer to the Bacteriophage Program or programs that are approved by the JSC.
Commercialization Committee (“CC”) Establish project plans and review and approve activities and budgets for Commercialization activities under the Bacteriophage Program.
Intrexon shall have the option and, in the event it so elects, shall use Diligent Efforts, to perform any manufacturing activities in connection with the Bacteriophage Program that relate to the Intrexon Materials, including through the use of a suitable Third Party contract manufacturer.
