AOL does not guarantee the precise time that such a backup will be completed, but does guarantee that it will begin within six (6) hours of the time indicated in such TW Company’s Special Backup Request.
A TW Company shall make all requests (each, whether a Special Backup Request or Restore Request, as defined below, are hereinafter referred to as a “Request”) associated with the Backup Service by sending an email to their AOL account manager or as otherwise identified by AOL to such TW Company.
Sublandlord shall provide such Additional Backup to Subtenant within a reasonable time following receipt of a timely Additional Backup Request.

With respect to any Sublandlord’s Statement, Subtenant’s failure to provide an Additional Backup Request by the Additional Backup Request Deadline or failure to provide an Overstatement Notice by the Overstatement Notice Deadline shall serve as conclusive evidence that Subtenant has approved such Sublandlord’s Statement in all respects, which Sublandlord’s Statement shall be deemed final and binding upon Subtenant.
No charge will be incurred for the Customer Data itself, provided that any activities and services performed by Maximizer for a Backup Requests shall be charged to Customer at Maximizer’s then-current Backup Request fee rates, and Customer shall be liable to pay such fees in advance of Maximizer’s delivery of any Backup Request.
After the 30 day period expires or delivery of the Backup Request (whichever is later), Maximizer may delete all Customer Data, and Customer will have no access to or use of the Customer Data.
