Examples of Background Results in a sentence
A Party wishing to publish in written form, oral presentation or make public in any other form, information relating to the Background, Results or any other information regarding the Project – confidential or not– will submit in writing to the Project Leader the intended publication 45 days before the intended publication date or before the date of submission for disclosure to review the publication.
If no objection is made within the time limit stated above and no Background, Results and Confidential Information of another Party is included in the publication, the publication is permitted.
Such Background, Results or other information is provided “as is” and is used at the sole risk and responsibility of the receiving Party.
No Access is provided to any Party or any third party for purposes of commercial exploitation whatsoever of any materials or associated Background, Results, or other intellectual property.
The Parties agree that any Background, Results, Confidential Information and/or any and all other data and/or information that is provided, disclosed or otherwise made available between the Parties during the implementation of the Action and/or for any Exploitation activities (“Shared Information”), shall not include personal data as defined by Article 4 Section 1 of the General Data Protection Regulation ( (EU) 2016/679) (hereinafter referred to as “Personal Data”).
Any Intellectual Property Rights based on or resulting from Background Results are referred to hereinafter as “Old Intellectual Property Rights”.
The defaulting Party shall return all Background, Results and Confidential Information received pursuant to this Consortium Agreement without delay.
The Recipient Institutes represent that any such Background Results are available for licensing as of the effective date of this Agreement.
