In the event that no fund is nominated, or stapled fund found, the default fund for this Agreement will be Aware Super.
All new employees, regardless of age will be registered in the Aware Super fund administered by Aware Super Pty Ltd unless the employee chooses to nominate an alternative complying fund from the register of Complying Superannuation Funds, or the Employer is otherwise required by law to make contributions to an alternative fund.
Unless otherwise specified by an employee, NSWALC will make employer contributions to Aware Super in accordance with clause (2).
In the event that the employee had not completed an application form within 28 days, the Employer shall forward contributions and employee details to Aware Super (“the Default Fund”) or where required by superannuation legislation to the employee’s stapled superannuation fund.
Where no such nomination is made before any such contributions become payable, the contributions referred to in this clause will be paid into the Employers default fund which is currently First State SuperAware Super Pty Ltd (ABN 11 118 202 672; AFSL 293340), the trustee of Aware Super (ABN 53 226 460 365).
Should the Employee not specify a fund of choice upon commencement and not have a stapled fund the Company will pay the prevailing Superannuation Guarantee Charge into one of the following approved funds: Australian Super; Aware Super; or CBUS.
In the event that an Employee does not nominate an alternative complying fund, does not have a stapled super fund, or the Employer is not otherwise required by law to make contributions to an alternative fund, Employer contributions will be made to Aware Super.
If the Employer is advised by the ATO that the Employee does not have a stapled super fund, the Employer will use Aware Super fund as the default fund.
