Available Premises definition

Available Premises means any suite(s) located on that portion of the Building’s second floor specifically delineated in Exhibit D which become available for leasing to third parties. Space shall not be deemed to be Available Premises if an existing tenant renews or extends its term pursuant to the terms of a written lease.
Available Premises means office space (and not lab space) which is located adjacent to the Premises on the third (3rd) floor of the Building that becomes available after the Commencement Date for leasing to third parties. Office space shall not be deemed to be Available Premises if an existing tenant renews or extends its term, whether pursuant to an existing option or otherwise. Office space which is being actively marketed by Landlord as of the Commencement Date shall not be deemed Available Premises until Landlord ceases to actively market such space or until any lease entered into by Landlord on such space shall expire.
Available Premises means the whole or any part of a floor in the Building which is not comprised in the Premises which may from time to time become available for Letting during the Term;

Examples of Available Premises in a sentence

  • If Tenant fails to notify Landlord of Tenant’s election within said five (5) business day period, then Tenant shall be deemed to have elected not to lease the Available Premises.

  • To the extent that Landlord renews or extends a then-existing lease with any then-existing tenant of any space, or enters into a new lease with such then-existing tenant for the same premises, the affected space shall not be deemed to be Available Premises.

  • If Tenant fails to notify Landlord of Tenant’s election within said ten (10) day period, then Tenant shall be deemed to have elected not to lease the Available Premises.

  • If Landlord does not lease the Available Premises within said one hundred twenty (120)-day period, then Tenant’s ROFR shall be fully reinstated with respect to the specific Available Premises, and Landlord shall not thereafter lease the Available Premises without first complying with the procedures set forth in this Article 43.

  • In the event Landlord makes to a third party, or receives from a third party, a offer to lease Available Premises that Landlord is willing to accept, Landlord shall provide written notice thereof to Tenant (the “Notice of Offer”), specifying the terms and conditions of a proposed lease to Tenant of the Available Premises.

  • In addition, space that has not been rented since the completion of the Building shall be Available Premises.

  • Space shall not be deemed to be Available Premises if an existing tenant renews or extends its term pursuant to the terms of a written lease.

  • Space shall not be deemed to be Available Premises if an existing tenant of such space renews or extends its term with respect to such space whether pursuant to the terms of an extension right or otherwise.

More Definitions of Available Premises

Available Premises means any office space between approximately 6,000 square feet and 10,000 square feet that becomes available for leasing to third parties during the Term and is located in the Building or in EmeryStation North, EmeryStation East or Heritage Square (which projects are owned by affiliates of Landlord).
