Examples of Authority Delay in a sentence
If a Milestone has not been achieved by the relevant Milestone Date, the Contractor shall pay to the Authority Delay Payments in accordance with the table as set out in Part 6.1 of the Order Form for each day of delay from and including the relevant Milestone Date until and including the date on which the relevant Milestone Criteria are actually achieved and the Authority provides the Contractor with a Milestone Achievement Certificate.
Except with respect to Work done or materials used as described in the foregoing sentence, if Work exposed or examined under this Article 9.10 is in conformance with the requirements of the Contract, then any Delay resulting from uncovering, removing and restoring Work shall be considered an Authority Delay, and Contractor shall be entitled to a Change Order for the cost of such efforts and recovery of any Delay occasioned thereby, subject to the provisions of Article 16.
For greater certainty, Dev Co shall not be entitled to any such additional payment pursuant to any such DPA Variation if and to the extent that the aggregate DPA Contracting Authority Delay Period during the DPA Term is less than or equal to 45 days.
