Except as just stated, Client will have no affirmative obligation to monitor or detect unauthorized activity of Users, including violations of the TOU, investigate reported incidents of unauthorized activity of Users or take affirmative steps to prevent infringement of the intellectual property rights of Synacor or Synacor Content Providers.

Synacor has no obligation to monitor the Client Materials (defined below) or other content provided by or for Client, except for Synacor Content (as defined in the Addendum).
With respect to terms of use of Synacor Content providers, where AT&T has had the opportunity to approve such terms of use, AT&T agrees to (A) incorporate such terms of use into the Portal TOS, or (B) otherwise permit Synacor to make such terms available on the Portal in a manner consistent with the Portal TOS.
The foregoing indemnity shall be Synacor’s sole and exclusive liability to AT&T, and AT&T’s sole remedy, with respect to the [*] Services, except to the extent, if any, liability is caused by (i) a breach of the [*] Agreement by Synacor or (ii) any Synacor Content included in any message sent under the [*] Agreement.
No license is granted under this Agreement to AT&T or any Third Party to use any trademarks, service marks, trade names or logos of any Synacor Content providers for any purpose.
The content included in the Premium Offerings is Synacor Content, as such term is defined in Schedule D to the Agreement.
