Attaching Party definition

Attaching Party means any Party wishing to make a physical Facility Attachment on or in any AT&T structure.
Attaching Party means any person, firm, corporation, partnership, or cooperatively organized association, other than a utility or a municipality, which seeks to construct attachments upon, along, under, or across public ways or private rights of way.
Attaching Party means the pole user or party entering into a pole attachment agreement with a utility;

  • AT&T shall give Attaching Party at least sixty (60) days’ written notice prior to abandoning, conveying, or transferring any Structure to which Attaching Party has already attached its facilities, or any Structure on which Attaching Party has already been assigned space.

  • Upon receiving such Notice, Attaching Party shall inspect the Facilities and take such steps as Attaching Party may deem necessary to insure that the Facilities meet Attaching Party’s performance requirements.

  • Such insurance and coverage shall not only cover the Attaching Party, but it must cover all contractors, subcontractors and/or any other person acting on Attaching Party’s behalf, that are providing services under this Agreement.

  • In addition, the Attaching Party shall be liable for an unauthorized Attachment and/or Occupancy fee as specified in the Pricing Schedule to this Agreement.

  • Neither Attaching Party nor Authorized Contractors selected by Attaching Party shall conduct such work in any manner which degrades the integrity of AT&T-22STATE’s Structures or interferes with any existing use of AT&T-22STATE’s Facilities or the Facilities of any other user.

  • AT&T shall provide Attaching Party with nondiscriminatory access to Poles, Ducts, Conduits, or Rights-of-Way owned or controlled solely by AT&T, or in part by AT&T where it has the right to allow such access, as required under the Pole Attachment Act, 47 U.S.C. § 224, or in the case of reverse preemption by a state, the applicable state law or regulations.

  • AT&T-22STATE will provide the Attaching Party advance written Notice of proposed date and time of the post-construction inspection.
