The employer shall refund to the employee the cost of an accident insurance for accidents occurring for the duration of posting, except for accidents at work or on travel within the meaning of the ASVG, which cause death or permanent invalidity.
In the event of an employee falling ill abroad, Section 130 ASVG or the relevant international social insurance treaty shall apply.
If an employee’s spouse, partner (within the meaning of the ASVG), children, adoptive children or parents die, the enterprise shall refund the cost of the home journey and shall handle the time of such home journey same as for a posting, provided that a home journey is actually made.
Upon request of the spouse, partner (within the meaning of the ASVG provisions), children, adoptive children or parents, the enterprise shall, in the event of the employee’s death during the period of posting, promptly arrange the return transport of his/her body and shall pay the requisite cost of return transport to the extent such cost is not covered by a third party (e.g. insurer).
Officials participating in any branch of the social insurance provided for in the ASVG or in the unemployment insurance provided for in the AlVG on account of their service with the Commission at the time of entry into force of this Agreement shall have the right within three months of that date to terminate their insurance in any branch by means of a written declaration to become effective on the last day of the month on which the declaration is made.
As of the effective date of their appointment with the Commission or after the completion of three years of continuous service with the Commission, officials shall have the right, in accordance with the provisions of Article 4 hereunder, to participate in any of the branches of social insurance under the ASVG and in the unemployment insurance under the AlVG.
The obligation to pay social security contribution underlies the Allgemeines Sozialversicherungsgesetz – ASVG (General Social Security Act).
The retirement age used to calculate the provisions for anniversary bonuses and severance pay is the statutory minimum retirement age as stipulated in the Austrian General Social Security Act (ASVG) (2004 reform) for the provision for anniversary bonuses, subject to a maximum age of 62 years.
In accordance with Section 35(4)(b) ASVG, the employee is also obliged to submit all the notifications prescribed in Sections 33 and 34 leg.
It is apparent to the contracting parties that due to the personal and entrepreneurial independence of the consultant, this Framework Contract or project assignments do not constitute an employment contract according to labour law, social law and/or tax law or a free service contract according to § 4 Abs 4 ASVG.
