Assigned Customer definition

Assigned Customer means any customer that Commerce Energy and PSE agree will be included as a Designated Customer as set forth from time to time in Exhibit A to the Operating Agreement (which is, as such Exhibit A may be amended by mutual written agreement of Commerce Energy and PSE, incorporated herein by reference) or an Affiliate from whom Commerce Energy has rights to receive payments.

Assigned Customer means a customer under an Assigned Contract who is currently receiving telecommunication services from Seller, including all Verizon wireless customers and all Research In Motion customers.

For the purposes of this section, "Original Permitted PSE Customer" shall mean a customer that is hereafter included as an "RSC" under and as defined in the Supplier Security Agreement dated April 12, 2006 with Pacific Summit Energy LLC, provided, that, written notice of the inclusion of such customer as such an "RSC" is given by Commerce Energy to Agent not less than thirty (30) days prior to the effectiveness of such inclusion, and provided, further, that, no Event of Default has occurred and is continuing as of the effective date of such inclusion or would result from such inclusion, and the sum of all Accounts owing by the Permitted PSE Customers shall not exceed $5,000,000 in the aggregate outstanding at any time. To the extent any Accounts or other Receivables are excluded from Collateral pursuant to this paragraph, the provisions of Sections 6.3(a) and (c), 7.2 and 7.5 will not apply to such excluded Accounts or other Receivables."

Assigned Customer means a Customer assigned to Agent for Star2Star’s obligation to make Payments.
