COMPANY shall deliver Concert Films to ITUNES with closed captioning in a country in the Territory in the following circumstances: (i) if a version of a Concert Film made available by COMPANY to any EST Provider and/or VOD Provider or in any other media (e.g., broadcast, theatrical exhibition, DVD) in such country includes closed captioning; (ii) if closed captioning is required by law in such country; or (iii) as provided in the Asset Specification Guide.
COMPANY shall otherwise deliver Concert Films to ITUNES in accordance with the Asset Specification Guide.
Where a Movie made available to Apple has neither a DVD/Blu-ray release nor a theatrical release and therefore no resulting rating by the appropriate content classification body or bodies in the applicable country of the Territory CDD shall notify Apple of the lack thereof and rate such Movie at the highest applicable category for such country as set out in the Asset Specification Guide.
For purposes hereof, unless otherwise provided in the Asset Specification Guide, “HD” shall mean a Concert Film with a vertical resolution of 720p or higher, and “SD” shall mean a Concert Film with a vertical resolution under 720p.
Unless otherwise stated in the Asset Specification Guide or otherwise communicated by ITUNES, COMPANY shall deliver each Concert Film made available for distribution in each particular country of the Territory with at least the languages (whether dubs, subtitles, or both) included on other versions of such Concert Film made available by COMPANY in such country (whether via DVD, EST or VOD), provided that COMPANY controls the necessary rights to provide such language versions to ITUNES hereunder.
