The Licensee is a TPP (as defined below) or an ASPSP (as defined below) The Licensee wishes to use the Marks in the Territory (as defined below) in relation to the Products/Services (as defined below) and the Licensor is willing to grant to the Licensee a licence to use the Marks on the terms and conditions set out in this agreement.
ASPSP: an Account Servicing Payment Service Provider as defined within Article 4 of PSD2.
Account Servicing Payment Service Provider or ASPSP – the third party payment service provider, such as a bank, with whom you hold an online payment account (Source Account) which we will access when you use our Service.
We are not responsible for the services or provided to you by the ASPSP.
The Client shall: (i) have obtained its personal authentication data before the first use of the Services; (ii) the Client shall follow and provide all the necessary information according to the instructions of LUXHUB and the relevant ASPSP; (iii) keep its personal authentication data confidential and safe; and (iv) not transfer, sell or otherwise disclose its personal authentication data to third parties.
In such cases, the ASPSP will no- tify the Client that access to the payment account is denied and the reasons therefore, before access is denied and at the latest immediately thereafter, unless providing such information would compro- mise objectively justified security reasons or is pro- hibited by Applicable Law and Regulations.
The Client acknowledges that the ASPSP may deny access to a payment ac- count for objectively justified and duly evidenced reasons relating to unauthorised or fraudulent ac- cess to the payment account by LUXHUB, including the unauthorised or fraudulent initiation of a pay- ment transaction.
The scope of data transmitted by the ASPSP may vary from an ASPSP to another, depend- ing on the scope of data put at the Client disposal in its e-banking.
The Client understands and agrees that LUXHUB solely provides AIS in relation to payment accounts held with an ASPSP which (i) has to comply with the PSD2 obligation to publish an API, (ii) has published such an API according to regulatory requirements, and (iii) is supported by LUX- HUB.
This consent is materialized as fol- lows: (i) ASPSP will display the details of the relevant Service(s) and (ii) if the Client agrees thereto, it shall authenticate itself with the authentication proce- dures provided by its ASPSP.
