Company may also be required to enter into such Supplemental Terms to access or continue to use the Apto Platform and the Services if Company seeks to alter or expand Company’s Program Specifications.
When Apto approves Company’s Apto Account, Apto grants Company a royalty-free, non-exclusive, revocable, and nontransferable license to use the Apto Materials as provided through the Apto Platform and solely as permitted by this Agreement.
Apto may also send text or SMS messages to Company’s Personnel to allow Apto to verify their identity, to provide other information about Company’s Apto Account, Cards, and Cardholder Accounts and for other purposes that Apto identifies and that are available through Company’s Apto Account or the Apto Platform.
To invite Customers to apply for Cards, establish Cardholder Account credentials, fund Cards, manage Cardholder Accounts, and view Cardholder Account statements, Company will integrate the Company Platform or Company App with the Apto Platform in accordance with the Developer Tool specifications.
Company may not apply for a Program, access the Apto Platform or use the Services unless Company consents to receive Notices electronically.
If Company does not agree with the terms of any amended Agreement, Company may close its Apto Account in a manner consistent with this Agreement or stop using the Apto Platform before it becomes effective as to Company.
Apto may update, and add or remove features to or from the Apto Platform, the Developer Tools and the Services in Apto’s sole discretion.
Apto may use any Feedback about the Apto Materials, the Apto Platform and the Services, or new features and functionality of the Apto Platform freely and without restriction.
Company is also responsible for obtaining consent from Company’s Personnel to share their Personal Information with Apto, and for disclosing to them that Apto may collect, retain, and disclose their Personal Information in connection with Company’s Program, and Company’s use of the Apto Account, the Apto Platform, and the Services.
Apto will provide Notices regarding Company’s use of the Apto Platform, Company’s Program Account, Cards, Cardholder Accounts and the Services to Company and Company’s Personnel electronically through the Dashboard, via email, push notification, or via text or SMS to the mobile phone number provided to Apto by Company, or Company’s Personnel.
