  • The APS Acquisition Loan shall be treated for all purposes herein as "Loans", including without limitation, for purposes of Section 2.17 and the definition of "Required Banks", with the exception that the amount outstanding under the APS Acquisition Loan shall not be treated as a Loan for purposes of determining compliance with the Borrowing Base hereunder.
