Except for a press release announcing this Agreement, Exhibit 3, (Approved Press Release Announcing Collaboration Agreement) that shall require the written approval of the other party, neither party shall originate any news release or other public announcement, written or oral, or otherwise make any disclosure relating to the existence or terms of or performance under this Agreement without the prior written approval of the other party, except as may otherwise be required by law.
The provisions and terms of this Agreement shall be summarized in a press release to be mutually agreed by OCLI, SICPA and Flex (the "Approved Press Release").
The issuance of the Approved Press Release shall be deemed a waiver of any other terms and conditions of this Article 35 and no further press releases may be issued by Purchaser prior to Closing.
Otherwise, no party may issue a press release or make a public statement regarding this Letter Agreement, the Suite License Agreement, any of the Agreements or the subject matter hereof or thereof providing any information which is not provided in the Approved Press Release without the other party’s prior written approval.

If either the Company or GMPTS is required by Law or the NYSE to issue any Press Release other than the Approved Press Release, such party shall endeavor to provide to the other at least two (2) Business Days prior to the issuance of the same, a copy of the proposed Press Release for its review.
Contemporaneously with the execution of this Agreement, the parties shall jointly issue the press release attached hereto as Exhibit AA (the "Approved Press Release").
Except for the Approved Press Release or any other press releases approved in advance by both parties, neither party shall make any statement to the media or press relating to the Lawsuit or this Agreement.
The Company will not issue any Press Release unless that Press Release is consistent in all material respects with the Approved Press Release or with Amendments which are not Materially Adverse Amendments.
