Applicable Individuals definition

Applicable Individuals means the Company’s directors, executive officers, all employees in Compensation Grades 50 and above and any other individuals designated as such by the Company from time to time.

Examples of Applicable Individuals in a sentence

  • In general, Applicable Individuals are generally defined as participants in a 401(k) plan under which a) the employer matching contribution was at a rate of 50% or more and was made in the form of employer stock, and b) in the year preceding the year of additional catch-up contrbution, the employer was i) a debtor under chapter 11 (bankruptcy) and ii) was subject to indictment or conviction as a result of business transactions relating to such bankruptcy case.

  • Effective January 1, 2007, "Applicable Individuals" are eligible to make special catch-up contributions to their Traditional IRAs that equal three times the catch-up limit in effect for the year ($1000 for 2006 and 2007 so the special catch-up amount would be $3000 for these years).

  • The Employer may allow divestiture of such securities upon completion of any period of service less than three (3) years applied on a uniform basis to all Applicable Individuals.

  • Limited Access to Data (Use as Applicable) Individuals will access data only for the purpose of this Agreement.

  • If the Plan includes Employer Securities as an investment option, the Plan Administrator shall provide Applicable Individuals with the right to divest the Employer Securities in their accounts and reinvest those amounts in other investment options offered by the Plan.

  • Section 2304 of the Act, which states that no NSP funds may be distributed to (a) an organization that has been indicted for a violation under federal law relating to an election for federal office or (b) an organization that employs Applicable Individuals.

  • A notice which complies with ERISA Section 101(m) must be provided to Applicable Individuals no later than thirty (30) days before the first date on which the Applicable Individuals are eligible to exercise their diversification rights.

  • If any portion of an Applicable Individual's Account attributable to Employer Contributions other than Elective Deferrals is invested in Publicly-Traded Employer Securities, then, except as otherwise provided herein, the Applicable Individual may elect to direct the Plan Administrator to divest any such Securities, and to reinvest an equivalent amount in other investment options which satisfy the requirements of Section 7.11(D).
