Applicable Election has the meaning set forth in Section 2.1(c) hereof.

• Any successor that is appointed to fill a vacancy pursuant to this Section 1(j) shall have the right to serve until the next Applicable Election, or until his/her successor is elected and duly qualified.

• Within five (5) days after each Applicable Election, BCSOE shall remove all BCSOE Property from the Polling Place.

• In the event the Participant waives the minimum 30-day requirement for the written explanation, the Applicable Election Period shall not end before the period ending thirty (30) days after the Participant receives the written explanation.

• Within 30 days after the Effective Date, each Party will name its representatives for the Screening Committee (designating one as its co-chair) and the Screening Committee shall hold its first meeting.

• This Agreement automatically expires 24 hours after the removal of all BCSOE Property after the last Applicable Election but may be earlier terminated for convenience by either Party in writing.

• The Plan amendment is not applicable with respect to an Optional Form of Distribution with an Annuity Starting Date that is earlier than the number of days in the maximum Applicable Election Period after the date that the amendment is adopted.

• Beginning 24 hours prior to and ending 24 hours after the License Period for each Applicable Election, BCSOE may use and occupy the Polling Place for BCSOE’s operation and conduct of the Applicable Elections (“Permitted Use”).

• The Participant may elect during the Applicable Election Period not to receive the Normal Form of Payment or Qualified Preretirement Survivor Annuity by execution and delivery to the Plan Administrator of a form provided for that purpose by the Plan Administrator.
