Examples of AOL Member in a sentence
For purposes of this Agreement, a "Prior Business Relationship" will mean that the AOL Member to whom commercial e-mail or other online communication is being sent has voluntarily either (i) engaged in a transaction with ICP or (ii) provided information to ICP through a contest, registration, or other communication, which included clear notice to the AOL Member that the information provided could result in commercial e-mail or other online communications being sent to that AOL Member by ICP or its agents.
ICP acknowledges that it has no rights or interest in AOL Member submissions to message boards, chat rooms or any other vehicles through which AOL Members may make submissions within the AOL Network.
Any person or entity (a) who registers for the AOL Network using ICP's special promotion identifier and (b) who remains an AOL Member for two paid billing cycles.
ICP shall ensure that any survey, questionnaire or other means of collecting Member Information including, without limitation, requests directed to specific AOL Member screennames and automated methods of collecting screennames (an "Information Request") complies with (i) all applicable laws and regulations, (ii) AOL's applicable Terms of Service, and (iii) any privacy policies which have been issued by AOL in writing during the Term (the "AOL Privacy Policies").
In cases where an AOL Member performs a search for ICP through any search or navigational tool or mechanism that is accessible or available through the AOL Network (e.g., promotions, Keyword Search Terms, or any other navigational tools), AOL shall have the right to direct such AOL Member to the ICP Internet Site, or any other ICP Interactive Site determined by AOL in its reasonable discretion.
In no event shall ICP (i) provide AOL Member names, screen names, addresses or other identifying information Member Information-) to any third party (except to the extent specifically (a) permitted under the Applicable Privacy Policies or (b) authorized by the AOL Members in question) or (ii) otherwise use any Member Information in contravention of the above section regarding "Solicitation of Members".
In the event that AOL has received substantial AOL Member complaints regarding a MERCHANT Technical Problem based on MERCHANT's failure to satisfy a site operating standard specified in this Agreement (and MERCHANT is unable to promptly resolve such MERCHANT Technical Problem following notice thereof), AOL will have the right to regulate the promotions it provides to MERCHANT hereunder until such time as MERCHANT corrects the MERCHANT Technical Problem at issue).
Recognizing the subjective nature of a custom-made floral order, to the extent that an error does occur or is alleged to occur by an AOL Member, FLOWERS will rectify the situation as set forth in Exhibit E.
