Review and approve Metro’s planning support work plan, described in Section C.1.A, below, and determine the Annual Project Budget and Budget Forecast to implement each Plan.
The Advisory Committee shall consider such Annual Project Budget and make recommendations (if any) to the Authority as to such Annual Project Budget not less than 60 days prior to the beginning of the next Fiscal Year.
The Authority shall cause copies of such adopted Annual Project Budget to be delivered to each Participant; provided, however, the Annual Project Budget for the Fiscal Year ended October 31, 2007 shall be prepared, considered and adopted by the Authority and delivered to the Participants and the Advisory Committee as soon as possible following the execution and delivery of this Agreement.
The Annual Project Budget shall include all necessary operating expenses, current maintenance charges, expenses of reasonable upkeep and repairs, taxes and special assessment levies, prorated amount required for insurance and all other expenses incident to the operation of the Project; and shall show the expected revenues to pay such expenses, including annual debt service requirements and reserve fund deposits and balances.
The Advisory Committee shall meet at least semi-annually, at least one of such meetings to be a joint meeting with the Authority for consideration of the Annual Project Budget as described in Section 404.
The Authority (if necessary) shall submit a revised Annual Project Budget to the Advisory Committee, and following approval of such Annual Project Budget by the Advisory Committee, proceed with the adoption of such Annual Project Budget not less than 30 days prior to the beginning of such Fiscal Year.
If the SVS Field Operator makes a determination during any Fiscal Year that it cannot perform its obligations under this Agreement without an increase in the expenditures authorized under the Annual Project Budget, the SVS Field Operator shall timely report such finding to the Authority and the BPMC and shall submit a revised budget with explanations and analyses where appropriate for the Authority's and the BPMC's review and approval.
The Authority will prepare and submit to the Advisory Committee and each Participant a proposed Annual Project Budget at least 90 days prior to the beginning of each Fiscal Year.
The Annual Project Budget, including any amendments proposed by the Borrower, shall be subject to the approval of the City, which approval shall not be unreasonably withheld or delayed.
The Authority will establish fair and nondiscriminatory charges relating to the Project designed to recover all of the operating costs allocable to the Project, as set forth in the Annual Project Budget.
