Annual Close definition

Annual Close. Down: Notwithstanding anything contained in the Awards, the Company when giving any leave in conjunction with the Christmas-New Year holidays may, at the Company's option, either: (i) stand off without pay during the period of leave any employee who is not yet entitled to an Annual Holiday; or (ii) stand off without pay during the period of leave any employee who is not yet entitled to an Annual Holiday and pay (up to the period of leave then given ) at a rate of one -twelfth of an ordinary week's wages in respect of each 38 hours continuous service (excluding over-time). Provided that, where the Company at its option decides to close down the establishment at the Christmas-New Year period for the purpose of giving the whole of the annual leave due to all, or the majority of the employees then qualified for such leave, the Company shall give at least one (1) months' notice to the employees of the Company's intention to do so. Provided also that where the Company requires work to be carried out during an annual close-down period notified as above, the Company may, subject "Lo the employees' agreement, recall an employee from annual leave, which agreement shall not be unreasonably withheld. In such cases the employee shall be credited with the amount of annual leave foregone, but shall not be entitled to a further payment of leave loading in respect of that leave.

Examples of Annual Close in a sentence

  • The ABC will notify an employee of the requirement to take annual leave or paid time off in lieu no later than one month in advance of the commencement of the Annual Close Down.

  • In order to meet the operational needs of the business during periods of low activity and or downtime in production or operations, the ABC may direct an employee to take a period of annual leave or paid time off in lieu at any time between 15 December and 15 January (Annual Close Down).

  • The amount of leave that the ABC can require an employee to take during the Annual Close Down is a minimum of 3 days and a maximum of 10 days.

  • If an employee has sufficient accrued annual leave or paid time off in lieu to cover the Annual Close Down, but there are exceptional circumstances which mean that being required to take the annual leave or paid time off would significantly adversely impact the employee, the employee may request that they be able to make other arrangements with the ABC.

  • In order to meet the operational needs of the business during periods of low activity and/or downtime in production or operations, the ABC may direct an employee to take a period of annual leave or paid time off in lieu at any time between 15 December and 15 January (Annual Close Down).

  • Annual Close Down: The company may close the business down during the Christmas-New Year period.

  • Note: If an Annual Close Down is proposed, refer to clause 87 for the process.

  • Such accumulated additional days off may be taken in conjunction with the Employee’s annual leave, an Annual Close Down (in accordance with subclause 21.13) or at another agreed time.
