Alternative Source definition

Alternative Source shall have the meaning set forth in the definition of "Eurodollar Rate".
Alternative Source means a source of water used by a Party to meet a Parcel’s annual Consumptive Use in addition to or instead of available Sustainable Yield of Native Groundwater or APA, as such is calculated pursuant to Section 1.8. An Alternative Source may include water available under a surface water right or contract, a recharge water account, or other source as allowed pursuant to Section 1.8.4.
Alternative Source has the meaning set forth in Section 9(a) hereof.

  • In the event that Indemnitee receives from the Company and an Alternative Source a duplicate payment in respect of the same expenses, judgments and fines or any other amounts incurred by Indemnitee, Indemnitee shall promptly reimburse the Company in the amount of such duplicate payment.

  • Where the Alternative Source is located outside the Territory, the scope of the license to manufacture under Section 2.1 shall be expanded automatically to permit the manufacture of the Product by the Alternative Source outside the Territory.

  • For clarity, Company itself or an affiliate of Company may be an Alternative Source.

  • In the event that the full Coal requirements for Buyer’s Facility are in excess of 900,000 tons per Delivery Year, Seller shall, in good faith, determine whether the tons in excess of the Basic Requirements (the “Additional Tons”) can be supplied from the Mine (including any Mine used to supply Substitute Coal for all or part of the Additional Tons) or any other Alternative Source on the same terms and conditions as it provides the Basic Requirements hereunder.

  • Alternative Source shall have the meaning specified in the definition of Euro-Rate.


More Definitions of Alternative Source

Alternative Source means the source as may be notified alongside the Primary Cost Plus source, offered under auction, to bridge the possible time gap between the operationalization of the EUPs and cost plus mine reaching to the capacity to cater full linkage quantity.

Alternative Source means, with respect to any matter that is the subject of a claim or threatened claim under the ▇▇▇▇▇▇▇▇ Guaranty, any of the following: (v) the letters of credit or bonds referred to in Section 4.8(e) (iii) and (iv) above are in amounts sufficient to pay the costs of addressing such matter and Purchaser is diligently addressing such matter to the satisfaction of the State; (w) Purchaser has sufficient financial and other resources to address such matter and does diligently address such matter to the satisfaction of the State; (x) any insurer which has issued an insurance policy with sufficient coverage available to pay the costs of addressing such matter has confirmed that such matter is covered by such insurance and Purchaser (or such insurer) is diligently addressing such matter to the satisfaction of the State; (y) the State has confirmed that the costs of addressing such matter will be paid out of the closure or long-term care funds maintained for the ▇▇▇▇▇▇▇▇ Facility and not pursuant to the ▇▇▇▇▇▇▇▇ Guaranty; or (z) the State has confirmed that it will not seek to recover such costs under the ▇▇▇▇▇▇▇▇ Guaranty.
