Alternative Benefits definition

Alternative Benefits means either:
Alternative Benefits means Covered Benefits that are provided by a program, plan or arrangement other than this Plan. Accordingly, for example, an “Alternative Cash Severance Benefit” means a Cash Severance Benefit that is an Alternative Benefit; an “Alternative Continued Medical Benefit” means a Continued Medical Benefit that is an Alternative Benefit; and an “Alternative Continued Life Insurance Benefit” means a Continued Life Insurance Benefit that is an Alternative Benefit. Notwithstanding the foregoing, a benefit that is designated an Alternative Benefit in a Participant’s Participation Notice shall be deemed to be an Alternative Benefit with respect to such Participant, and a benefit that is designated as not an Alternative Benefit in a Participant’s Participation Notice shall not be deemed to be an Alternative Benefit with respect to such Participant. Any benefit provided to a Participant other than by this Plan which is not addressed in the Participant’s Participation Notice shall be deemed to be an Alternative Benefit if such benefit is described in the first sentence of this Section 2(a).
Alternative Benefits means an award granted by the Committee under the Comerica Incorporated 2006 Amended and Restated Long-Term Incentive Plan, as it may be amended and/or restated from time to time, or its successor plan, to a Participant where the Committee, in its sole discretion, expressly grants such award in lieu of an award earned but not paid for a particular performance period under the Comerica Incorporated 2016 Management Incentive Plan, as it may be amended and/or restated from time to time, or a successor or predecessor plan.

Examples of Alternative Benefits in a sentence

  • The Company’s determination that a particular Member’s medical condition renders the Member a suitable candidate for Alternative Benefits will not obligate the Company to make the same or similar determination for any other Member; nor will the provision of Alternative Benefits to a Member entitle any other Member to Alternative Benefits or be construed as a waiver of the Company’s right to administer and enforce this Contract in accordance with its express terms.

  • The Member may qualify for Alternative Benefits, at the Company’s discretion, based on various criteria, including diagnosis, severity, length of illness, and proposed or rendered treatment.

  • Alternative Benefits provided under the Article are provided in lieu of the Benefits to which the Member is entitled under this Contract and accrue to the maximum Benefit limitations under this Contract.

  • Unless expressly agreed upon by the Company, all terms and conditions of this Contract, including, but not limited to, maximum Benefit limitations and all other limitations and exclusions, will be and shall remain in full force and effect if a Member is receiving Alternative Benefits.

  • We determine, in Our sole discretion, that the Member is no longer a suitable candidate for the Alternative Benefits or that the Alternative Benefits are no longer necessary.

  • Notwithstanding any other provision herein, whether either party agrees to Alternative Benefits or an amendment to this Agreement is within the party’s sole discretion.

  • The Member receives care, treatment, services, or supplies for the medical condition that are excluded under this Contract, and that are not specified as Alternative Benefits approved by Us.

  • If Alternative Benefits are offered and accepted, then this Agreement will not terminate as a result of the University Notice but instead will remain in full force and effect with the Alternative Benefits.

  • If there are any other modifications to this Agreement as a result of the Alternative Benefits being substituted for the Benefits, the Parties will execute an amendment to this Agreement setting forth each such modification.

  • Health Benefit Allowance amounts not exhausted for the purchase of benefits under the Alternative Benefits and Compensation Plan will be paid to the employee in taxable cash or the employee may choose to allocate said monthly sum toward, life insurance, Flex Spending Dependent Care, Flex Spending Medical, Flex Spending Commuter Benefits, and other benefits specified in the program.
