Design Build Entity demonstrates the Allowance is necessary by establishing that: (i) the Work constitutes Allowance Work; and (ii) the failure to obtain pricing or bids did not result from any Error or Omission, or any other error, by Design Build Entity, including, without limitation, Design Build Entity’s failure to comply with the Subcontractor Procurement Process.
If the Project Contingency is exhausted or the Judicial Council does not approve the use of Project Contingency funds, the Design Build Entity shall be responsible for any overage costs for the associated Allowance Work at Design Build Entity’s sole cost and expense.
Construction Contractor shall not proceed with any portion of the Work associated with the aforesaid allowance (“Allowance Work”) without first obtaining Owner’s express written authorization to proceed with said Allowance Work.
Landlord shall construct and complete the Building (the “Building Work”) and certain initial interior improvements to the Leased Property (the “Tenant’s Improvement Allowance Work;” collectively, the Building Work and Tenant’s Improvement Allowance Work are referred to as the “Landlord’s Work”) to the extent required to substantially comply with plans and specifications attached to this Lease as EXHIBIT D (the “Plan of Work”), and made a part hereof by this reference.
From the commencement of this process there will be no entitlement for officers to claim any allowances provided for in the LGEAS, other than Live Sewer Work Allowance, Work in the Rain and Clause, Meal Allowance during overtime.
The Allowance Work shall be performed and installed by or on behalf of Tenant at its sole cost and expense, subject to the application of the Allowance.
Work covered under an Allowance shall be accounted for on the same basis as extra work (i.e., the same percentages for overhead and profit and general conditions that apply for extra work would be applicable to Allowance Work).
If the costs of any item to which an Allowance applies shall be greater than the amount of the Allowance, Construction Manager shall so notify Owner and if Owner authorizes the Allowance Work, the Construction Cost and Guaranteed Maximum Price shall be increased by such difference without adding any additional Construction Fee.
The term "Tenant Change", as used in this Lease, does not include either the Allowance Work or the Tenant's Work.
Landlord is providing to Tenant an allowance in the amount of $369,000.00 ("Maximum Construction Allowance") for the installation of general office space and a shipping/receiving office at the Demised Premises, generally as described on Exhibit E ("Allowance Work"), which Allowance Work is part of the Landlord's Work (as defined in Section 18(b)).
