Upon the Executive’s death on or after February 1, 2017, whether during his employment with the Corporation or following the termination of his employment for any reason, the Corporation shall pay to the AJK Dynasty Trust dated March 17, 2003 (the “Beneficiary”) a payment of three million five hundred thousand dollars ($3,500,000) (the “Death Benefit”).
The Borrower and the Association hereby agree that the obligations set forth in Sections 9.03, 9.04, 9.05, 9.06, 9.07 and 9.08 of the General Conditions (relating to insurance, use of goods and services, plans and schedules, records and reports, maintenance and land acquisition, respectively) shall be carried out by AJK pursuant to Section 2.03 of the Project Agreement.

Any action required or permitted to be taken, and any document required or permitted to be executed, under this Agreement on behalf of AJK may be taken or executed by the Additional Chief Secretary, Planning and Development Department or such other person or persons as AJK shall designate in writing, and AJK shall furnish to the Association sufficient evidence of the authority and the authenticated specimen signature of each such person.
The following is specified as an additional matter, within the meaning of Section 12.02(b) of the General Conditions, to be included in the opinion or opinions to be furnished to the Association, namely, that the Project Agreement has been duly authorized or ratified by the Provinces and AJK, and is legally binding upon the Provinces and AJK in accordance with its terms.
With respect to the first four contracts each in NA and AJK and, thereafter, each contract for vehicles, equipment, materials and works estimated to cost the equivalent of $200,000 or more, the procedures set forth in paragraphs 2 and 3 of Appendix 1 to the Guidelines shall apply.

No amendment, modification, supplement, extension, or reinstatement of [the AJ&K Implementation Agreement,] the Energy Purchase Agreement, the Water Use Agreement, [the Site Lease,] or any other Project Agreement shall affect this Agreement or increase the liability of the GOP under this Agreement or the Guarantee, unless such amendment is approved in writing by the GOP, prior to such amendment being executed between the parties thereto.
In order to assist the Borrower, the Provinces, AJK and FATA in carrying out the Project, the Borrower, the Provinces, AJK and FATA shall employ consultants whose qualifications, experience and terms and conditions of employment shall be satisfactory to the Association.
