Subject always to the provisions of Clause 23.1(a) relating to Liabilities in respect of claims arising out of Aircraft Refuelling, liabilities in respect of all third party claims other than those referred to above in Clause 23.1(b)(i) shall be borne by the Participants provided that to the extent (if any) that such third party claims arise out of the negligence of a particular Participant or any of its employees, agents or representatives, then such liability shall be borne by that Participant.
Unless otherwise required by local or national regulations, ITP shall also develop a list with the unpumpable Fuel quantity of the piping and equipment of each Dispenser and each Refueller, plus the total quantity of all Dispensers and Refuellers that shall be used for Aircraft Refuelling and deliver it to Operator at the date of the signature of this Agreement.
Suppliers shall add and maintain at all times the Into Plane Agent, MAFFFL, MIAL and AAI as co-insured under the Aircraft Refuelling Liability Policy taken out by the Suppliers.
It is further expressly agreed that each time any Dispenser or Refueller or other equipment suitable for Aircraft Refuelling gains Access to the Facility assets, ITP automatically confirms that the Dispenser or the Refueller is fit for purpose, by full compliance with JIG Standards and manufacturer’s requirements of respective vehicle or equipment.
Each of the Parties hereby acknowledges and agrees that, as between the Operator, the ITP, the Suppliers and the Airport Users, the ITP shall act as the agent of the relevant Supplier(s) or the Airport User(s) for the purpose of Aircraft Refuelling on behalf of such Supplier(s), or Airport User(s) and for no other purpose.
The terms of this agreement are intended to cover work associated with aircraft handling, including but not limited to the following: • Embarking/Disembarking of Passengers • Loading/Unloading of Passenger Baggage • Loading/Unloading of Freight • Aircraft Refuelling • All check-in and Ticketing Functions.
Should damage or defects be observed by Operator at the Pit Valves, the Fuel Loading Assets or Test Rig during its duties to fulfill the maintenance requirements of the Operator as per Clause 3.1, then Operator has the right to request ITP to carry out an investigation, including but not limited to providing all reasonable means to Operator, so to inspect their equipment used for Aircraft Refuelling.
The ITP has been granted by the Airport Company Infrastructure Owner the contractual right to provide Aircraft Refuelling services at the Airport and has obtained the required regulatory approvals where necessary, which are still valid and have not been revoked or modified.
For this purpose, the ITP shall provide to Operator, prior to the signage of this Agreement, with a written confirmation, listing all vehicles and / or equipment used for Aircraft Refuelling and their compliance with all the aforementioned requirements.
Should a Dispenser or a Refueller be found to have caused such damage, ITP shall withdraw it from its use for Aircraft Refuelling as detailed in clause 3.3 above.
