AHP Subsidy definition

AHP Subsidy means the original principal amount of this Note and Agreement set forth above.
AHP Subsidy or “subsidy” means the funds awarded by the Bank under this Agreement. This Agreement shall be binding upon the parties and upon any successor in interest to the parties.

Examples of AHP Subsidy in a sentence

  • Upon the death of the AHP-assisted sole owner, or owners in the case of multiple title holders, the AHP Retention Agreement terminates and there is no obligation to repay the AHP Subsidy.

  • The obligation to repay the AHP Subsidy to the Lender and to the Bank and the requirement that the AHP-Assisted Unit be occupied during the Retention Period as provided in Section 5(a) shall terminate if leasehold or legal title to the AHP-Assisted Unit is transferred by foreclosure or deed-in-lieu of foreclosure, if the first leasehold mortgage on the AHP-Assisted Unit is assigned to the Department of Housing and Urban Development (HUD), or after the death of the Owner.

  • If, after final disbursement of AHP subsidies to the member, the member undergoes an acquisition or a consolidation resulting in a successor organization that is not a member of the Bank, the nonmember successor organization assumes the member's obligations under its approved application for AHP Subsidy, and where the member received an AHP subsidized advance, the nonmember assumes such obligations until prepayment or orderly liquidation by the nonmember of the subsidized advance.

  • The payment obligation described in this Note and Agreement represents the AHP Subsidy.

  • The Lender’s obligation to repay the AHP Subsidy to the Bank is governed by the Bank’s AHP Policies and Procedures.

  • If the funds cannot be delivered to the Project within this time, the FHLBNY Member Financial Institution must return any unused AHP Subsidy to the FHLBNY.

  • The Sponsor shall ensure that the AHP Subsidy is used solely for the purposes set forth in the approved AHP Application and in accordance with this Agreement and the AHP Requirements.

  • If the property, for which the AHP Subsidy funds are used, is located on land held in trust by the United States government for a Native American Tribe, is located on Native land in the State of Alaska conveyed by the Alaska Native Claims Settlement Act (as amended), or is located on Hawaiian Home Lands created under the Hawaiian Homes Commission Act, 1920 (as amended), the Member, Sponsor and/or the Bank shall have no right to sell, foreclose, or occupy the AHP-Assisted Unit.

  • Once the FHLBNY Member Financial Institution receives a credit of the AHP Subsidy, the FHLBNY Member Financial Institution agrees to deliver the full dollar amount of the funded AHP Subsidy to the Sponsor or owner within thirty (30) days.
