Aggregate Settlement Fund definition

Aggregate Settlement Fund means the Settlement Fund described in Paragraph 4 of the Terms of the Settlement below.
Aggregate Settlement Fund means the sum of Eighty Million and no/100 Dollars ($80,000,000.00) that Defendants collectively will pay into an Escrow Account pursuant to the terms and conditions of the Escrow Agreement, in a proportion to which they have agreed and which shall be disclosed only to the Escrow Agent (in accordance with Sections IV.A.1., IV.A.2 and VII.A.2(d)) ) and to no one else in a confidential side letter from Defendants, plus any interest, dividends and other distributions and payments earned on that sum.‌
Aggregate Settlement Fund means the sum of the Settlement Fund and the $2,150,000.00 Sempris previously paid as consideration for settlement of the claims alleged against it.
