Affiliated Entity(ies) definition

Affiliated Entity(ies) means any corporation or other entity, now or hereafter formed, that is or shall become affiliated with Newmont Mining, either directly or indirectly, through stock ownership or control, and which is (a) included in the controlled group of corporations (within the meaning of Code Section 1563(a) without regard to Code Section 1563(a)(4) and Code Section 1563(e)(3)(C)) in which Newmont Mining is also included and (b) included in the group of entities (whether or not incorporated) under common control (within the meaning of Code Section 414(c)) in which Newmont Mining is also included.
Affiliated Entity(ies) means any corporation or other entity, now or hereafter formed, that is or shall become affiliated with the Company, either directly or indirectly, through stock ownership, control or otherwise, as determined by the Company.
Affiliated Entity(ies) means any corporation or other entity, now or hereafter formed, that is or shall become affiliated with the Company, either directly or indirectly, through stock ownership, control or otherwise, as determined by the Company, including but not limited to Newmont Mining Corporation ("NMC").

Examples of Affiliated Entity(ies) in a sentence

  • At least five (5) days prior to the Wendover Notice Deadline Purchaser shall promptly advise Sellers in writing of the names, address and telephone number of the Affiliated Entity(ies) that will be assigned and will assume the rights and obligations this Agreement applicable to the Wendover Village II Property pursuant to the provisions of Section 15.7.

  • In case HREYN has affiliated entity/ies, indicated as Affiliated Entity/ies by the Grant Contract, costs incurred by such entity/ies may be eligible, provided that they satisfy the same conditions under Articles 14 and 16 of the Annex II to the Grant Contract, and that HREYN ensures that Articles 3, 4, 5, 6, 8, 10 and 16 of the Annex II to the Grant Contract are also applicable to the entity/ies.

  • In case MIO-ECSDE has affiliated entity/ies, indicated as Affiliated Entity/ies by the Grant Contract, costs incurred by such entity/ies may be eligible, provided that they satisfy the same conditions under Articles 14 and 16 of the Annex II to the Grant Contract, and that MIO-ECSDE ensures that Articles 3, 4, 5, 6, 8, 10 and 16 of the Annex II to the Grant Contract are also applicable to the entity/ies.
