adverse remark definition
adverse remark means any written remark by a reporting officer or head of the office which, read in its full context, is adverse and also includes anything else in a report which the Commission may indicate as adverse;
adverse remark means a remark, which indicates the defects or deficiencies in the quality of work or performance or conduct of an officer, but does not include any word or words in the nature of Counsel or advice to the officer. 83It was held that “Court in its inherent jurisdiction can expunge the adverse remarks only if such remark were not justified in the sense that it were wholly wrong or improper and expunging thereof is necessary to prevent abuse of the process of the Court or otherwise to secure the ends of justice”.84 In the above case85 the court also laid down certain criteria which are relevant to consider while expunging any remark.
