The amount of weekly Residential Fees applicable as at the date of admission and the proportions for which each payer is responsible as at the date of admission are stated in the Admission Request.
If we know the amount of the Local Authority Funding when this Agreement is signed, that amount should be stated in the Admission Request.
The Residence Terms in this Part 2 together with the Admission Request (in Part 1 above) completed by you, us and any Guarantor and/or Third Party Contributor form the agreement for provision to you of accommodation and certain services in the Home (this “Agreement”) between you, us and any Guarantor and/or Third Party Contributor.
Before signing this Admission Request, please read the Residence Terms set out in Part 2 on page 8 onwards.
There can be no assurance that Holders generally or any Holder in particular will receive the Notice described above with sufficient time to enable the Holder to deliver the Admission Request, the Voting Instruction Card and related confirmation of beneficial ownership to the Depositary in a timely manner.
The Company and the Depositary agree that in the event the Depositary does not receive any of (i) the Notice, (ii) the Admission Request or (iii) the Voting Instruction Card on or prior to the date specified therefore in this Paragraph 17, the Depositary shall have no obligation to distribute or forward, as the case may be, such notice or instruction card or prepare the applicable confirmation of beneficial ownership.
The Residence Terms in this Part 2 together with the Admission Request completed by you, us and any Guarantor and/or Third Party Contributor form the agreement for provision to you of accommodation and certain services in the Home (this “Agreement”) between you, us and any Guarantor and/or Third Party Contributor.
Upon receipt by the Depositary of (i) an Admission Request in writing and (ii) such evidence of beneficial ownership as shall be reasonably satisfactory to the Depositary, the Depositary shall, as promptly as practicable prior to the date of such meeting, notify the Company in writing of a Beneficial Owner’s intention to attend such shareholders’ meeting to ask questions and otherwise to participate in the meeting; provided, however, that Beneficial Owners shall not be entitled to vote at the meeting.
