  • Upon not less than ten (10) days’ notice from AR to ADLC, such books of record shall be at all times during business hours subject to the inspection and audit of AR, at AR’s expense.

  • This Modification Agreement shall be effective as of the date recorded in the ADLC real property records.

  • AR and ADLC now desire to reconfigure the dimensions and legal description of the Golf Course Parcel, as it was conveyed by and defined in the Golf Course Parcel Deed, to be consistent with the final operating dimensions and footprint of the Old Works Golf Course, as it was constructed and is now operating.

  • In satisfaction of the requirements in Section H of the ▇▇▇▇▇▇ Parcel Deed and the ▇▇▇▇▇▇ Ridge Parcel Corrective Deed, AR and ADLC state that they have provided written notice to and obtained the approval of EPA and the State of Montana for the modification to the Restrictive Covenants set forth in this Modification Agreement, as evidenced by the Consent to Modification of Restrictive Covenants attached hereto as Attachment 2.
