If the Additive or tender of delivery of the Additive fails to conform to the applicable Additive Purchase Order, the applicable Additive Specifications or this Agreement as determined by the GFE or its designee (including End Users), in their commercially reasonable discretion, and GFE or such designee exercises GFE’s right of rejection in accordance with this Agreement, the risk of loss and title to such quantities of Additive shall revert to ECOS.
