The Additional Funding Amount shall not exceed US$200,000,000 and shall be specified in the Additional Funding Request Notice.
After receiving the foregoing information, the Company shall determine, in its sole and absolute discretion, whether to fund the amounts requested in the Additional Funding Request or any portion thereof.
Without limiting the foregoing, TES Member will use good faith efforts to fund its payment obligation in respect of an Additional Funding Request within 10 Business Days after the date of receipt by the Series A Preferred Members of notice of such Additional Funding Request to the extent TES determines in its sole discretion that it has access to immediately available funds from its revolving line of credit.

Notwithstanding the foregoing, the Trustee shall have no responsibility with respect to items (1)-(3) of the Additional Funding Request except to include, without review or investigation, the information received by the Trustee from Settling Defendants or their designee pursuant to Paragraph 6.e. hereof.
The Board, in its discretion, may make an Additional Funding Request of its Members at any time, provided that, Members shall not be obligated to provide such Additional Funding Request to the Roundtable if such funding is not included in the budgeting process as described in Section 9.2 as additional appropriations of the Members will be required and may not be available at the time of the Additional Funding Request.
The Trustee shall submit the proposed Additional Funding Request to Settling Defendants, Settling Federal Agencies, and EPA for review.
The amount of the Additional Funding Request provided by the Trustee shall be subject to EPA approval.
In addition, Laredo shall provide to the Company such additional information regarding the Additional Funding Request as the Company may reasonably request.
Within five (5) days of the Trustee’s receipt of EPA’s written approval of such Additional Funding Request, the Trustee shall present the Additional Funding Request to Settling Defendants and Settling Federal Agencies for payment, with a copy to EPA.
